By attending Moms and Tots you agree to the following terms and conditions:

Parental Responsibility

Moms and Tots is not a childcare facility, but a structured class for caregivers and their toddlers to enjoy together. You are responsible for supervising your child at all times, during and after the class, just as you would in any public setting.

While every effort has been made to provide a safe and stimulating environment, Moms and Tots | The Parks cannot be held liable for any injury, loss, or harm that may occur while attending classes at 22 Jan Smuts Avenue, Johannesburg. Children must be supervised by their parent, guardian, nanny, or designated caregiver at all times.

Indemnity and Liability Waiver

By entering the premises at 22 Jan Smuts Avenue, including all indoor and outdoor areas, you do so at your own risk.

Moms and Tots, its owners, franchise, employees, and affiliates accept no liability for any injury, death, loss, or damage to personal property, regardless of the cause, including any act of negligence.

Fees and Payment

Fees are invoiced according to your selected payment plan (monthly or termly, in advance) and are payable upon receipt of your invoice.

Notice Period

A full term's written notice is required if you wish to withdraw from the programme. Notice must be submitted via email to theparks@momsandtots.co.za. Failure to provide the required notice will result in continued liability for fees for the following month or term.

Refund Policy

Moms and Tots does not offer refunds under any circumstances, including for missed or unattended sessions.

Non-Attendance and Make-Up Sessions

Fees are due regardless of attendance. If you are unable to attend a session, please inform the Workshop Leader in advance where possible.

Make-up sessions are not guaranteed. A maximum of one session per term may be rescheduled, subject to availability and at the sole discretion of the Workshop Leader. Make-up sessions must be taken within the same term.

Holiday Schedule

Moms and Tots follows a private school term calendar (three terms per year). Classes do not run during school holidays or on public holidays. Exact term dates are always available on our website.

POPI Act and Privacy Policy

In line with the Protection of Personal Information Act, 2013 (POPIA), Moms and Tots | The Parks collects and retains personal information solely for the provision of services, operational requirements, and compliance with applicable laws.

By enrolling, you consent to the collection, use, and processing of your and your child’s personal data in accordance with our Privacy Policy. You warrant that you have obtained the necessary consent for us to process personal information of any third parties you provide (e.g., caregivers).

Marketing and Use of Photographs

We regularly share photographs and videos from our classes on social media platforms, including Facebook and Instagram, as part of our marketing efforts.

By attending classes, you acknowledge and agree that images or videos of you and/or your child may be used for these purposes. If you prefer not to have your or your child’s image shared, please indicate this clearly on your registration form, and we will ensure that you are not featured in any content.

Class Disruptions and Cancellations

In the unlikely event that a class needs to be cancelled by the Workshop Leader (e.g., due to illness or an emergency), you will be offered a rescheduled class or credit at a later date.

Force Majeure

Moms and Tots shall not be held liable for any failure to provide services due to events beyond our control, including natural disasters, strikes, pandemics, or other acts of God.
